1. Purpose and scope
These General Terms of Use (hereinafter referred to as "GTU") govern the access and use of the e-commerce website accessible at the following URL: https://yavenstaliva.com/ (hereinafter referred to as the "Site").
Any person accessing the Site and using its services (consultation, account creation, order placement, browsing, etc.) is referred to as a "User". The User acknowledges having fully read and accepted these GTU without reservation before any use of the Site. The Operator reserves the right to modify these GTU at any time; the modifications will take effect upon their online publication on the Site. The User is invited to regularly consult the updated GTU.
These GTU are applicable to all services and content offered on the Site, and complement the General Terms of Sale (GTS) specific to commercial transactions, which are accessible separately on the Site.
2. Access to the Site
The Site is accessible free of charge to any User with an internet connection and suitable equipment (computer, smartphone, tablet). The Operator makes every effort to ensure continuous and secure access to the Site but does not guarantee permanent availability, without interruption or technical error.
The Operator reserves the right to suspend, interrupt, or limit access to the Site, particularly for reasons of maintenance, updates, security, or resolution of technical malfunctions, without having to justify its decision or pay compensation to the User.
The User is solely responsible for the material organization of their access to the Site, as well as the costs associated with this connection (internet package, equipment, etc.).
3. User account creation and management
To access certain services of the Site (placing orders, tracking orders, storing delivery data, etc.), the User must create a personal account by providing accurate, complete, and up-to-date information (surname, first name, email address, postal address, etc.). The user account is strictly personal and non-transferable. 4. User obligations
The User undertakes to use the Site in accordance with applicable French and European law, these GTU, and good internet usage practices. The User is notably prohibited from:
- Disrupting, altering, or interrupting the normal operation of the Site, undermining the security of the Site, or accessing data not intended for the public;
- Performing hacking, spamming, phishing, or any fraudulent practice on the Site;
- Copying, reproducing, modifying, exploiting, or distributing all or part of the Site's content without prior written authorization from the Operator;
- Disseminating illicit, offensive, defamatory, obscene, violent content, or content contrary to public order and good morals;
- Using the Site for commercial activities not authorized by the Operator, particularly the resale of products or unsolicited prospecting;
- Infringing the intellectual property rights of the Operator or third parties.
5. Intellectual property
All content present on the Site (texts, images, photographs, videos, logos, trademarks, graphics, source codes, databases, etc.) is protected by intellectual property law and belongs to the Operator or its partners/rights holders.
Any reproduction, representation, distribution, modification, adaptation, or total or partial exploitation of this content, without prior written authorization from the Operator, is strictly prohibited and constitutes an infringement punishable by criminal and civil penalties.
The User only has a right of private and personal consultation of the Site and its content. Any other use is prohibited.
6. Protection of personal data
The Operator collects and processes the User's personal data in compliance with the General Data Protection Regulation (GDPR) and the French Data Protection Act of January 6, 1978, as amended.
The terms of collection, processing, and protection of personal data are detailed in the Privacy Policy accessible on the Site. The User has rights of access, rectification, deletion, opposition, restriction of processing, and portability of their data, which they can exercise by contacting the Operator at the contact details indicated on the Site.
7. Operator's responsibility
The Operator undertakes to implement all reasonable means to ensure the quality and accuracy of the content offered on the Site. However, the Operator does not guarantee the absence of errors, omissions, or technical malfunctions on the Site.
The Operator's liability cannot be engaged:

Any User wishing to insert a hypertext link to the Site must obtain prior written authorization from the Operator.
10. Applicable law and dispute resolution
These GTU are governed by French law. Any dispute relating to the interpretation, execution, or breach of these GTU will be submitted, in the absence of an amicable agreement, to the jurisdiction of the competent French courts.
In accordance with consumer legislation, the consumer User may resort to consumer mediation to resolve a commercial dispute with the Operator, before any judicial action.
11. Miscellaneous provisions
If any of the clauses of these GTU is deemed void or unenforceable by a competent authority, the other clauses remain fully in force.
The fact that the Operator does not avail itself of a violation of these GTU by the User does not constitute a waiver to exercise its rights later.
